The Division of Labor Standards and Statistics may assist employees performing work in Colorado with the recovery of earned compensation not paid in accordance with Colorado Wage and Hour Law. If you wish to file a Wage Complaint with the Division, you must fully complete and submit to the Division a Wage Complaint form. The form includes instructions on the complaint process and the authority of the Division of Labor Standards and Statistics. Retaliation and Interference Complaint
Under the Public Health Emergency Whistleblower Act (“PHEW”) (effective July 11, 2020) (and Colorado Whistleblower, Anti-Retaliation, Non-Interference, and Notice-Giving Rules, 7 CCR 1103-11), the Colorado Healthy Family and Workplaces Act of 2020 (“HFWA”) (effective July 14, 2020) (and Wage Protection Rules, 7 CCR 1103-7), and Colorado wage and hour law, complaints alleging retaliation and/or interference with the exercise of protected rights or activity may be filed with the Colorado Division of Labor Standards and Statistics.

- Authorized Representative Form / Forma de Representante Autorizado
Wage Claimants and Employers may designate representatives to assist in any aspect of the Division's wage complaint process. The wage complaint process includes the investigation conducted by the Division's Compliance Investigator and the appeals process through the Division's Hearing Officer. Representatives may be attorneys, non-attorneys, relatives, non-relatives, organizations.
- Demand for Payment of Wages / Solicitud Formal Para El Pago Del Sueldo
If your employer owes you wages or compensation, you may also wish to complete and send to your previous employer an optional form entitled "Demand for Payment of Wages," which is provided as an administrative courtesy. Do not send the "Demand for Payment of Wages" form to the Division of Labor Standards and Statistics.
- Bounced Checks
If your former or current employer's payments to you are with a dishonored check, you may wish to send the "Notice of Dishonored Instrument" form, which is provided as an administrative courtesy. Do not send the "Notice of Dishonored Instrument" to the Division of Labor Standards and Statistics.
- Employer Response Form
If you are an employer and have received a Notice of Complaint from the Division of Labor Standards and Statistics for wages earned on or after January 1, 2015, the Employer Response Form must be completed and returned to the Division. Do not complete the "Employer Response Form" and send to the Division of Labor Standards and Statistics unless the Division has sent you a "Notice of Complaint" requesting a response.

Wage Claim Settlement Agreements
Whether to consider a settlement of a wage claim is up to the claim parties. The Division takes no position on whether any party should settle. Settlements must be informed and voluntary, not coerced or induced by fraud. Below is an optional wage claim settlement agreement form. If the claim parties choose to settle their dispute rather than continue with the Division's investigation, they can use the Division's form, or choose to create their own separate settlement agreement.

Unemployment Insurance and Workers' Compensation Tips and Leads
While the Division of Labor Standards and Statistics does not enforce laws and regulations regarding unemployment insurance and workers' compensation, other divisions within the Department of Labor and Employment do.
