Equal Pay for Equal Work Act, Part 2

Part 2 of the Equal Pay for Equal Work Act details employer requirements to include compensation, benefits, and application deadlines in job postings; notify employees of job opportunities and hiring decisions; and keep job description and wage rate records.

Job Application Fairness Act

Effective July 1, 2024, the Job Application Fairness Act (JAFA) restricts employers from asking about age-related information on initial job applications, with limited exceptions for age requirements based on legal or safety needs. Under JAFA, an employer may not ask about age-identifying information such as date of birth or graduation dates or dates of attendance at an educational institution. When asking for additional application materials, employers must inform applicants that they may redact age-related information.

If you believe that the employer has violated the Act, you may file a complaint with the Division by filling out the Job Application Fairness Act Complaint Form. The Division only accepts complaints in writing or electronically and you must complete the form in its entirety, attaching any evidence you have of the alleged violation.

Chance to Compete Act ("Ban the Box")

The Colorado Chance to Compete Act, commonly referred to as “Ban the Box,” is intended to provide people with criminal records with a more meaningful chance to compete for a job in the workforce and grow Colorado’s economy while protecting employers’ ability to make whatever hiring decision the employer deems appropriate. Under the Act, employers may not ask about an applicant’s criminal history on an initial job application or state in an application or advertisement that a person with a criminal history may not apply for the position.

If you believe that the employer has violated the Act, you may file a complaint by filling out the Colorado Chance to Compete Act Complaint Form. The Division only accepts complaints in writing or electronically and you must complete the form in its entirety, attaching any evidence you have of the alleged violation.

Social Media and the Workplace Law

The Social Media and the Workplace Law prohibits employers from accessing employees’ and job applicants’ personal social media accounts. Specifically, an employer may not require an employee or applicant to disclose a social media username or password, require that the applicant or employee add anyone to a social media account, or suggest or require an applicant or employee to change privacy settings associated with a social media account.

If you believe that the employer has violated the law, you may file a complaint by filling out the "Social Media Complaint" form. The Division only accepts complaints in writing or electronically and you must complete the form in its entirety, attaching any evidence you have of the alleged violation.

Credit History on Applications

Employment Opportunity Act (Credit History Law)

The Colorado Employment Opportunity Act prevents employers from requesting or using credit information (such as credit reports) in employment decisions for certain employees and job applicants in Colorado. More information about the Credit History Law, including which employers it does not apply to, can be found on this fact sheet.

If you believe that the employer has violated the law, you may file a complaint by filling out the “Credit History Complaint” form. The Division only accepts complaints in writing or electronically and you must complete the form in its entirety.
