Why Verify Compliance

In Colorado, all businesses with at least one employee must have workers' compensation insurance, though some may qualify for an exemption. Businesses, including independent contractors, must either have insurance or file a rejection of coverage with the state. If they do nothing, they are not compliant with the law.

If an employee is injured while working for an uninsured employer, the employer is responsible for medical care and wage benefits, which can cost upwards of $500,000 in severe cases.

Additionally, contracting with an uninsured employer can pose risks. For instance, if your business hires an uninsured roofing company and one of its workers is injured, both you and the roofing company may be held liable for their medical costs and lost wages.

Requesting a business's certificate of insurance indicates past coverage but doesn’t always confirm current status. The Division of Workers' Compensation (DOWC) provides two databases: one to verify active workers’ compensation insurance and another to check if a business has legally rejected coverage.
