Rejection of Coverage (WC 43): New Online Form Submission Option

Several Updated Rules Effective January 1, 2025

Following recent rule hearings, changes to Rule 16: Utilization Standards, Rule 17, Exhibit 4: Medical Treatment Guidelines Shoulder Injury, and Rule 18: Medical Fee Schedule become effective on January 1, 2025. Each of these adopted rules can be viewed on the DOWC's Proposed and Adopted Rules page.
WC15 Workers' Claim for Compensation and WC18 Dependent's Notice Updated for Accessibility

The DOWC has published accessible PDF files of both the WC15 Workers' Claim for Compensation and the WC18 Dependent's Notice and Claim for Compensation forms. The new accessible versions appear almost identical to previous versions, but offer significantly improved functionality for stakeholders using assistive technologies. The DOWC is committed to making its services accessible to all Coloradans. DOWC EDI Claims Release 3.1, Version 1.0 Requirements are Now Available

The Colorado Division of Workers' Compensation (DOWC) is excited to announce that it will be transitioning from the International Association of Industrial Accident Boards and Commissions (IAIABC) Electronic Data Interchange (EDI) Claims R1 to EDI Claims R3.1, effective October 13, 2025.
The EDI Claims Release 3.1, Version 1.0 Requirements (Revision Date: 10/16/2024, Effective Date: 10/13/2025) will soon be available on the EDI Requirements page of Verisk's DOWC EDI website.

Rule Hearing: Rule 11 - Division Independent Medical Examination

New WC43 Form Covers All Requests to Reject Coverage

The DOWC recently published an updated Rejection of Coverage for Corporate Officers or Limited Liability Company (LLC) Members and Construction Industry Partners or Sole Proprietors form (WC 43). The new WC43 has been streamlined and must now be used for all requests to reject coverage. There is no longer a separate coverage rejection form for partners or sole proprietors in the construction industry (previously known as the WC45). DOWC EDI Upgrade

The Division of Workers' Compensation (DOWC) is excited to announce that it's moving forward with changes to the Electronic Data Interchange (EDI) utilized by the DOWC. Claims administrators use this system to electronically file First Reports of Injury and Notice of Contests with the DOWC. The DOWC currently uses the International Association of Industrial Accident Boards and Commissions' (IAIABC) EDI Claims Release 1.0 and is upgrading to EDI Claims Release Standard 3.1, which is the most current release offered by the IAIABC.
As of today, this is the tentative timeline, which is subject to change:
1) EDI 3.1 requirements review: Now through August 2024
2) 3.1 announcement of intent to mandate release 3.1: September 2024
3) Stakeholder education and preparedness: September 2024 to February 2025
4) Testing for internal users and vendors: February 2025 to October 2025
5) System launch: October 2025
The DOWC has contracted with Verisk to service the EDI upgrade. Please watch for outreach from the DOWC or Verisk as the DOWC continues to engage stakeholders about this transition to 3.1. 2024 Max Benefits Order Available

The Director has issued the Maximum Benefits Order for 2024-2025, effective July 1, 2024. This order sets forth the maximum weekly TTD benefit and adjusts the maximum disfigurement benefit, lump sum limits, and combined benefit caps.
Revised Rule 7 Adopted

Changes to Rule 7: Closure of Claims and Petitions to Reopen have been adopted. The only changes were made to the mortality table. The new rule will be effective on July 1, 2024.
New Colorado Uninsured Employer Funding Memo

The Colorado Uninsured Employer (CUE) Fund exists to provide financial assistance to individuals injured while working for employers who did not carry workers’ compensation insurance. No Proposed Changes to Surcharge Rates

The Division of Workers' Compensation (DOWC) has concluded its annual review of the premium surcharge rates. After review, the DOWC will not be changing the premium surcharge rates for the upcoming year. The rate for carriers remains at 1.43 and for self-insureds at 1.40. As there are no changes to current rates, there will be no rule hearing for the upcoming year. More information can be found on the Surcharge Collection page. Upcoming Unit Closures and Service Disruption

Please be advised that multiple units at the Division of Workers’ Compensation will be closed on specific dates in April. While closed on the following dates, stakeholders will not have access to any of the services offered by these units. If you need services from these units, please contact them before the scheduled closures.
The Customer Service Call Center and Front Desk will be closed on April 22 and April 29. Contact Customer Services at cdle_wccustomer_service@state.co.us. The Prehearings and Settlement Conference Unit and Call Center will be closed on April 4 and April 5. You can contact the Prehearings Unit at cdle_dowc_prehearings@state.co.us.

DIME Transformation Project Update

On December 18, 2023, Government Performance Solutions (GPS) and the DOWC met with the external Advisory Team. The purpose of the meeting was to discuss the suggestions for improvement that the internal DOWC Core Team put forward. The Advisory Team provided feedback on the potential improvements to the DIME process, and the Core Team will reconvene in January 2024 to refine proposals. New Form for Continuing CUE Fund Benefits

The Division of Workers’ Compensation has released the WC204 form for the continuation of Colorado Uninsured Employer (CUE) Fund benefits. Claimants receiving benefits from the CUE Fund must complete and submit this form by April 1 to continue receiving benefits in the following fiscal year (July 1 - June 30). The CUE Fund exists to provide financial assistance to individuals injured while working for employers who did not carry workers’ compensation insurance.
2023 Workers' Compensation Act (WC Act)

March is Brain Injury Awareness Month

March is Brain Injury Awareness Month. Brain injuries are a leading cause of death and disability in the United States, and half a million Coloradans have experienced a brain injury. More than 250,000 of those have sustained a moderate to severe Traumatic Brain Injury (TBI). Some of these injuries occur in the workplace. Prioritizing workplace safety and staying up to date on workers’ compensation insurance requirements helps reduce the number of incidents and provides coverage for medical and lost wage benefits when injuries happen on the job. Mileage Reimbursement Rate Updated

The mileage reimbursement rate increased from $0.50 to $0.56 per mile. The Division of Workers' Compensation's Quick Reference Guide has been updated to reflect this increase.
New Required Interpreter Invoice Form

As a result of changes to Rule 18, there is a new and required form for interpreter invoicing. Beginning January 1, 2023, interpreters are required to use and submit this form to carriers for reimbursement for their services.
Emergency Rule 11

The Colorado Division of Workers’ Compensation adopted emergency Rule 11. The Division is taking this step as the recently adopted version of Rule 18, effective 1/1/2023, no longer includes indigence standards. As a result, the Division adopted this emergency Rule 11 to ensure that indigence standards remain in place until the proposed permanent version of Rule 11 is effective.

New Emergency Rule 5 in Effect & Upcoming Hearing

An updated version of emergency Rule 5 is in effect from December 6, 2022, through April 5, 2023. The previous version of emergency Rule 5 was terminated on November 23, 2022. The most recently adopted changes to Rule 5 were initially redlined on an outdated version of the rule. Although the proposed redlined changes were correct, other sections of the recently adopted rule did not reflect changes that became effective on July 1, 2021.
